The Church Fathers on this verse

Deuteronomy 17:8Meaning & Commentary from the Church Fathers

If thou perceive that there be among you a hard and doubtful matter in judgment between blood and blood, cause and cause, leprosy and leprosy: and thou see that the words of the judges within thy gates do vary: arise, and go up to the place, which the Lord thy God shall choose.

Consider how the priestly figure is adorned with the glory of Christ in other significant ways. He explicitly calls out, stating: ‘For the Father also judges no man, but has given all judgment to the Son, that all may honor the Son as they honor the Father’ (John 5:22-23). Likewise, through the words of the apostle, it is proclaimed: ‘One Lawgiver and Judge,’ as noted in the Scriptures (James 4:12). Additionally, the holy David proclaims: ‘as God is the Judge’ (Ps. 49:6).

The Lawgiver, who endows those from the sacred lineage with such esteemed authority to judge, instructs in Deuteronomy: ‘If in any matter it be difficult for thee to judge between blood and blood, between judgment and judgment, between wallpaper and wallowing, and there be dissenting opinions in thy gates, arise, and go to the place which the Lord thy God shall choose... and thou shalt come to the priests the Levites, and to the judge that shall be in those days, and ask them, and they shall tell thee how to judge....’ It is evident that the Law expressly mandates that individuals seeking to lodge a grievance for any cause must present themselves before the priestly judge and decision-maker.

What is the significance of the phrase, "If thou hast not a word with thee in judgment between the blood, and between the judgment, and between the pestilence," as found in Deuteronomy 17:8? If you struggle to discern the truth while assessing a leprosy on the body (which Moses refers to as a pestilence), and are unable to identify whether it is leprosy or another affliction (Lev. 13:39), refrain from making assumptions or passing judgment based on conjecture. Instead, seek guidance from the divine temple and present your case to the priest or to those who are tasked with the oversight of the people. Follow their instructions without hesitation. However, should anyone, in their pride, choose to oppose what is declared by the bishop or judge, they are to face the death penalty as a deterrent and for the instruction of others.
